Landmark CJEU ruling on cross border employment and contracts

The complexity of determining which country's employment laws apply to cross-border workers is not a new phenomenon. The recent Court of Justice of the European Union case of Hortis GRC SA v JA (C-768/24) is an example of the courts clarifying the rules surrounding choice of law in modern remote and cross-border working arrangements. The Court of Justice issued a preliminary ruling on the interpretation of Article 6(2) of the Rome Convention in a dispute between Hortis and an employee regarding the applicable law for their employment contract.
