Government to appeal High Court ruling on sectoral pay
In a judgement that issued from the High Court on Tuesday the 23 June 2020 in the case of National Electrical Contractors of Ireland (NECI) v the Labour Court and Others, Justice Simons has ordered that the provision under the 2015 IR Amendment Act to make sectoral employment orders (SEOs) is unconstitutional having regard for the separation of powers provision in the constitution that provides the power to make law to the Oireachtas, and only to the Oireachtas.
