WRC issue its first decision regarding Right to Request Flexible and Right to Request Remote Working
The first decision in a case taken by an employee against her employer (a technology company) is helpful in that it reaffirms that the Work Life Balance and Miscellaneous Provisions Act 2023 and the Workplace Relations Commission Code of Practice provide the right to request remote working, as opposed to the right to work remotely. However, it is also clear from the decision that employers need to ensure that they are able to evidence that they have considered any request in accordance with the requirements of the Code in relation to considering such a request and have complied with the prescribed timelines.
