Labour Court rules dismissal was fair in HR Executive’s post maternity redundancy
A Labour Court decision (UDD2629) provides important guidance for employers managing redundancies involving employees returning from maternity leave. The case demonstrates that while employees on protective leave enjoy significant legal protections, a dismissal may still be fair where an employer can clearly establish that a genuine redundancy situation exists and follows a reasonable consultation process.
