Overview

The Safety, Health and Welfare at Work Act 2005 defines intoxicants as “including drugs or alcohol or a combination of both” and includes prescribed and non-prescribed drugs. The misuse of intoxicants may impair the ability of an employee to perform their duties effectively and safely and may endanger their co-workers, the public and cause damage to company property. Many employers are having to deal with issues relating to the use, dependency, or misuse of intoxicants or substance abuse in the workplace. Traditional concerns for employers were generally regarding alcohol consumption. However, the fact that Irish people are the joint-fourth highest consumers of cocaine globally, according to the latest global report on Cocaine the United Nations report ( Global Report on Cocaine 2023 from the United Nations Office on Drugs and Crime (UNODC) ), means that employers are now having to consider other forms of misuse or influences from drugs such as cocaine and cannabis. According to the United Nations report, 2.4 per cent of Irish people reported using cocaine during the previous year, the same as in the US and Austria. Only Australia, the Netherlands and Spain reported higher levels of cocaine use. The report also warned of the potential of future violence in Ireland due to competition for expanding cocaine markets and the rise in use of crack cocaine. The most effective way of ensuring that drugs are not a problem in the workplace is to have a comprehensive policy that outlines any safety concerns around the misuse of intoxicants and seeks to support those that need help with addiction issues in a non-judgemental way. The policy can be referred to as Misuse of Intoxicants Policy, Drugs and Alcohol Policy or Substance Abuse Policy as suits your Organisational Preference. Policies should be developed and implemented through consultation and agreement with employees, safety representative and unions where applicable. Employers are also required to conduct a risk assessment where misuse of intoxicants is identified as a hazard in the workplace and to put control measures in place to avoid the adverse effects of intoxicants used inappropriately in the workplace.
