The Maternity Protection, Employment Equality and Preservation of Certain Records Act 2024 amends the Maternity Protection Act 1994 by the insertion of a new section which introduces an entitlement in the Act for an employee who requires ongoing treatment for a serious health condition, including physical and mental health conditions, to postpone maternity leave for a period of between 5 and 52 weeks.

The claimant commenced employment with the respondent, a family-owned business involved in vehicle sales and maintenance, as a Junior Salesperson on the 3 January 2023. She was dismissed on the 8 May 2023 and claimed that the dismissal arose due to her pregnancy.
