SI 146 of 2000 is a statutory instrument that sets out the Code of Practice on Grievance and Disciplinary Procedures. This Code of Practice contains general guidelines on the application of grievance and disciplinary procedures and the promotion of best practice in giving effect to such procedures. The Code of practice emphasizes that disciplinary investigations should comply with the principles of natural justice and fair procedure. This was addressed by the High Court in Bank of Ireland v James Reilly [2015] IEHC 241 and the more recent Supreme Court decision in the case of O’Sullivan v HSE [2023] IESC 11.

In a recent Labour Court determination, the Court concluded that a County Council Worker was entitled to have his regular rostered overtime included in the calculation of his pay while on annual leave. The case came before the Court on appeal from an earlier WRC Adjudication officer decision. During the appeal hearing, the Court heard that the claimant’s regular overtime constitutes more than 22% of his weekly wage overturning an earlier decision by a WRC Adjudication Officer.
Supreme Court finds a personal grievance can also be protected disclosure
A recent Supreme Court decision has confirmed the broad scope of the Protected Disclosures Act. The Court ruled that complaints made by employees that are entirely personal to them are still capable of being deemed as protected disclosures for the purposes of the Protected Disclosures Act 2014.
