WRC finds employee not entitled to bonus due to be paid after employment ended

The issue of bonus payments regularly arises particularly where an employee is leaving close to or at the time of the payment of a bonus. In recent weeks a Workplace Relations Commission (WRC) adjudicator dismissed a claim under the Payment of Wages Act 1991 for commission payments brought by a sales manager who resigned from his job after 9 months in the role. The claimant brought his action under Section 5 of the Act, which deals with deductions from pay.

Increased entitlement to parental leave from September

The number of weeks of unpaid parental leave will increase from 18 to 22 weeks from 1 September 2019. Meanwhile November of this year will see the introduction of 2 weeks paid parental per parent for children born on or after 1 November 2019.

Code of Practice on the Right to Disconnect

The Code of Practice on the Right to Disconnect was published in April 2021. The code provides guidance and best practice for employers and employees with respect to compliance with employment legislation.​ Failure to follow a Code prepared under section 20(1)(a) of the Workplace Relations Act, 2015 is not an offence in itself​. However, the legislation provide provides that in any proceedings before a Court, the Labour Court or the WRC, that a Code of Practice is admissible in evidence and any provision of the Code which appears to be relevant to any question arising in the proceedings shall be taken into account in determining that question​.
