Claims under the OWT Act in relation to compensatory rest and Sunday premium

The onus is on employers to show that they are fully compliant with all aspects of the Organisation of Working Time Act 1997. The legislation applies to most employees, with few exceptions. Working time is governed in Ireland by the Organisation of Working Time Act 1997. The OWT Act and subsequent Regulations govern the working hours of employees aged 18 years and over. The Act deals with all aspects of working time, break periods and minimum rest requirements in the workplace. The Act also deals with annual leave and public holiday entitlements.

Minister confirms that right of employees to seek paid Domestic Violence Leave will apply from 27 November

Speaking at the Green party annual convention in Cork city earlier this month, Minister for Children, Equality, Disability, Integration and Youth RoderIck O'Gorman is reported to have confirmed that the right of employees to seek paid Domestic Violence Leave will apply from 27 November of this year. On that date, Ireland will become one of the first countries in the EU to introduce this measure.

WRC awards compensation to driver dismissed for disconnecting the vehicle tracker in company van

The case of A Builder v a Construction Firm (ADJ-00050150, November 2024), relates to a decision by an employer to dismiss an employee who was interfering with the vehicle tracker on the company van that he was driving. The case demonstrates once again the importance of applying fair procedures in the disciplinary process. It also affirms that a company should have clear policy on the use of vehicle tracking devices that complies with requirements under the Data Protection Acts 1998 to 2018 and the General Data Protection Regulation (GDPR) which the legislation incorporates.

Minister Humphreys secures Cabinet approval for introduction of new Pay-Related Jobseeker's Benefit system and flexible access to State Pension

The proposed introduction of pay-related Jobseeker's Benefit is just one of a series of major social welfare reforms announced in recent weeks by the Minister. Other reforms include landmark changes to the State pension, an increase in Parent's benefit from 7 to 9 weeks, extension of Child Benefit to 18 years old in full time education as well as other measures.

In a recent decision by the Workplace Relations Commission (WRC), an employee successfully brought a case against his employer for breaching its obligations under the Work Life Balance and Miscellaneous Provisions Act 2023.

Balance for Better Business is an independent business-led Review Group established by the government in 2018 to improve gender balance in senior leadership in Ireland.

Government approves policy proposals to recognise families created through surrogacy

The number of employees becoming parents through surrogacy and seeking support from their employers has increased significantly in recent years. At present, there is no specific legislation in Ireland to govern either domestic or international surrogacy. However, in recent weeks, Government has approved policy proposals aimed at ending the legal limbo for families created through surrogacy.
