Revision of EWC Directive moves towards final stages
Trilogue negotiations with the EU institutions on legislative proposals for an amended EWC Directive are due to begin in the coming weeks and are expected to be concluded by mid-2025. As trilogue negotiations commence next month, there are a number of proposals of the EU institutions which continue to be of concern including the proposed broadening of the definition of transnational and proposed amendments to the consultation requirements. Further proposals as regards the payment of legal representation, experts, and training are also a cause for apprehension for businesses.
Extra parent's leave expected once necessary law is enacted but benefit unlikely before April 2021
Parent’s Leave and Benefit will be extended from 2 weeks for each parent to 5 weeks as announced in Budget 2021. This extension will be made available retrospectively to parents of children born or adopted on or after 1st November 2019.

This case to the Labour Court resulted from an appeal of an Adjudication Officer’s decision by the Company. The Adjudication Officer issued a decision under the Unfair Dismissals Acts ordering the Respondent to pay compensation of €45,000 to the Claimant.
WRC finds charity workers retirement age valid for succession planning reasons
Mandatory retirement ages have become increasingly difficult to justify and enforce, however in a recent case before the Workplace Relations Commission, an Adjudication Officer found that the employer satisfied the conditions under Section 34(4) of the Employment Equality Act 1998 which provides that it shall not constitute age-based discrimination to fix a retirement age for employees if it is objectively justified by a legitimate aim and the means of achieving that aim are appropriate and necessary.
