Mandatory retirement - lessons from recent case law
The emergence of the qualifying age for the State pension as a general election issue together with a slew of recent case law means that compulsory company retirement age will continue to dominate the HR agenda this year.
The age of entitlement to the State pension is due to rise to 67 on the 1st January 2021. The public sector saw a rise in their contractual mandatory retirement age on the 1 January 2019 to 70 years of age for public servants recruited before 1 April 2004.
