Shift worker unable to fulfil contractual obligation to work evenings awarded €20,000
26/06/2018 - A shift worker unable to fulfil what the company regarded as his contractual obligation to work evenings was recently awarded €20,000 for discriminatory dismissal. Prior to terminating his employment, the employer had explained that there were no day shift positions available in any section of the plant, a position that was unlikely to change.
Employee public holiday entitlements - the cost of getting it wrong
25/06/2018 - A WRC Adjudication Officer will, in general, look back over the 6 months prior to the claim being lodged to determine the level of award. In arriving at the level of compensation, the AO will consider whether the breach arose in error or by design.

25/06/2018 - In one of a number of recent race discrimination cases an Asian warehouse operative for a distribution firm outlined three instances of discrimination against him. One involved racist graffiti on a wall about the Asian race, another where a co-worker mocked him in a Chinese accent.

25/06/2018 - Ibec is deeply concerned about the amendments made at Committee Stage to the Employment (Miscellaneous Provisions) Bill 2017. Some of the amendments which passed include the narrowing of the bands of hours to as little as 3 hours in some cases and a new requirement to give existing part-time staff first refusal on all additional hours regardless of skills, qualifications or experience.

WRC issues Annual Report for 2017
24/05/2018 - The recently published Workplace Relations Commission report reveals that 4,370 hearings were held in 2017, a 24% increase on the number held in 2016. The WRC inspection service carried out 4,747 inspections last year, more than half of which were unannounced. In 125 cases employers were prosecuted post inspection.
IHREC issues guidelines on the issue of retirement and fixed-term contracts

Ibec cautions against further minimum wage rise

28/07/2016 - There has been a steady increase in the number of queries and requests arising under the Data Protection Acts 1988 to 2003 from employees to their employers in recent years. While some have referred to “digital ambulance chasing”* the reality is that employees, as data subjects, have considerable rights under the legislation. These rights, and employers’ obligations, look set to increase in strength and impact when the legislation is reformed as part of the General Data Protection Regulation due to come into effect in 2018.
The future of mandatory retirement ages - what the law now requires of employers
28/04/2016 - The Equality (Miscellaneous Provisions) Act 2015 has introduced significant changes to retirement ages. Consideration must now be given by all employers to objectively justifying both their contractual retirement age, and a fixed term contract if one is provided post contractual age. The means of achieving the aim must be both appropriate and necessary. Retirement ages and the implications of the Act for employers will be covered extensively at Ibec's Employment Law Conference 2016.
