Redundancy

The Redundancy Payments Acts cover individual rights in a redundancy, whereas the Protection of Employment Acts make provisions a collective redundancy situation. Ibec have available a number of publications to help guide members who are currently dealing with a redundancy situation. These publications examine the legislation which employers need to comply with when implementing a redundancy or lay-off or short-time working.

Ibec Redundancy Report 2016

30/01/2017 - A total of 373 companies provided information on conditions of employment in 2016, of whom 86 (23%) had implemented redundancies in the preceding twelve months. The attached document set out comprehensive information in relation to redundancy.

Cases relating to unfair selection for redundancy

27/01/2017 - Under the Unfair Dismissals Acts 1977-2015, redundancy is considered to be a fair ground for dismissal. Two of the most important characteristics of redundancy must be impersonality and change. For a fair redundancy to take place, the emphasis must be on the job and not the person. The onus is on the employer to prove that a genuine redundancy took place and that the processes and selection criteria used were fair
